Medpot Dispensaries Demand Equal Speaking Time by Ryan ZumMallen | Archive | 02.12.10 |
+ 6:15am | As the Long Beach City Council has inched towards passing an ordinance regulating local medical marijuana businesses, some local collectives worry that the tables are being shifted in a direction that leads to unnecessary regulation akin to a recent ordinance passed by the City of Los Angeles. Long Beach lobbyist Carl Kemp of the Kemp Group – who represents about ten local medpot dispensaries – says that supporters of medical marijuana collectives have not been allowed ample discussion and presentation time in front of the City Council. His beliefs stem mainly from Mayor Bob Foster’s decision to offer public speakers on the issue two minutes to address the Council, instead of the normal three minutes, because that particular City Council meeting was running long. In addition, Kemp said Thursday, the Mayor’s office invited Los Angeles District Attorney Steve Cooley – notorious for his hard stance against medical marijuana dispensaries – to address the Council during their upcoming Tuesday meeting. Kemp made numerous attempts to secure equal time for a presentation, but had not heard back from the Mayor’s office with a response. “You give [Cooley’s office] a platform to make their argument before a vote, and you don’t give anyone else the opportunity to give a counterpoint?” Kemp says. “That flies in the face of democracy, and it flies in the face of this argument that you’re trying to make sure that things are done right. You’re trying to make sure, in my view, that these things are done in the most restrictive way, and all but eliminate them from being in this city, when you’ve already agreed that they are medicine.” In Kemp’s eyes, both moves could slow momentum that seemed to be leaning toward the approval of an ordinance that both the City and medical marijuana dispensaries agreed on. Restricting the allotted public speaking time and inviting an outside legal opinion are a hindrance, he says, to the hard work that has already gone into crafting a very intricate ordinance that seems to hold a majority Council vote to approve. Taylor Honrath, a legislative aide to Mayor Foster, said that next Tuesday’s presentation would be made by staff from Cooley’s office and not the District Attorney himself, and that the intention is not to shift the Council’s decision one way or another but simply to share similar experiences with crafting an ordinance in Los Angeles and how it relates to the process in Long Beach. Long Beach’s proposed ordinance is viewed as more collective-friendly than the one adopted by Los Angeles just a few weeks ago. Some collectives have threatened to sue Los Angeles for being too restrictive. In the past, District Attorney Cooley has promised to specifically target marijuana dispensaries for prosecution and publicly pleaded with the Los Angeles City Council to ban all sales. “Their experiences with regulation, I imagine, will be part of the discussion and how Long Beach fits into the County,” Honrath said. “The District Attorney’s office isn’t coming in here to deliver an anti-collective message.” Honrath said that the exact meeting agenda had not yet been finalized, but that worries from Kemp and his collective clients were unnecessary. The presentation from Cooley’s staff will not represent either viewpoint, he says. Kemp says that he believes the City Council has been “extremely progressive” with their willingness to work fairly with medical marijuana dispensaries on several key issues. While there are several areas that he believes could be improved upon, Kemp said that overall his clients are pleased with the ordinance that has been crafted and seems close to Council approval. The City Council was scheduled to issue a final vote on the ordinance during last Tuesday’s meeting, but the Mayor delayed the vote by one week, expressing concerns that dispensaries would not be required to grow their own marijuana on their property or purchase it within city limits – even though the City Council voted 5-4 the week prior not to regulate purchasing restrictions. Foster says that the city may be making itself vulnerable by allowing dispensaries to purchase their marijuana from anywhere without restriction. But Kemp says that forcing them to grow on their own property would be near impossible with the water and heating demands that the plants require. “If I were a property owner in Long Beach, I wouldn’t want medical marijuana grown in my property,” Kemp says. “Not because of any philosophical view, but because of what it might do to my building.” In addition, Kemp says, requiring marijuana to be locally grown creates a safety risk because such places are commonly broken into. He expressed concern that those opposed to the ordinance had been proposing more restrictions in recent weeks, capped off by the Mayor postponing a final Council vote by one week in order to allow the office of a famously opinionated District Attorney to make a presentation. Kemp says he understands the concern that Mexican drug cartels could benefit by selling marijuana to the dispensaries, but proposes that the ordinance include a regulation that they must purchase the product within the state of California and not specifically in Long Beach. SameStory The pro-med marijuana people have spoken in front of council many times before. They are like a broken record. They just want marijuana made legal. They are the ones that do not want council to hear opposing viewpoints. No Point Ther is no point of more presentations. The City Council has long ago made up their collective minds. For all intents and purposes, he's running unopposed, yet he's putting a stumbling block in the way of the ordinance (the issue of on-site growing) which was crafted to reflect state law. If I wanted to entice criminals into my backyard, the easiest way would be to grow my own pot and let everyone know it's there. Shemp Carl Kemp has a right to make a living as a paid lobyist wherever he can, but given that, his discussion of democracy rings a little hollow. Let's not jump to conclusions too quickly. Long Beach has learned a great deal from the LA city experience and many believe that our city has done a good job so far. As to the source of the "medicine", should we really embrace "don't ask, its not our responsibilty?" Marijuana cultivation is already destroying public lands in our forests and ending lives at our borders. We really do need to get this right before we sanction more of the same. Bill C Having attended that meeting, it was simultaneously frustrating and encouraging that many patients were willing to suffer through a seven hour meeting for the opportunity to speak to the council. It didn't seem fair that Mayor Foster imposed a greater restriction on their time than was imposed on everyone else. Everyone in that room was tired and wanted to go home, but that's not a good reason to discriminate. Ty There's no rocket science to this one. Let the Council make policy in line with the WILL OF CALIFORNIA VOTERS and get out of the way! Dick Caley A recent article in the LA Times by Jerry Hirsch stated the number of Medical Marijuana dispensaries in La was more than Starbucks and McDonalds, combined! Obviously there is no shortage of suppliers. I urge our City Council to go slowly and look carefully at LA. We don't need to compete with LA for this business. Dennis Having listened first-hand to a Steve Cooley presentation last Saturday, I would place him as Pro-Safe Neighborhoods. And, heaven forbid we succumb to the Will of the CA voters. Given the condition of the State now, how much more do you want? Tired arguments. Cooley was clear that he will continue to prosecute based upon State and Federal laws. Cultivating on site or restricting the limits to stay within Long Beach is crazy and unheard of. You know how many grow sites there will have to be?? How many break ins do you think will happen?? There are more than 300 starbucks in LA and more than 400 MCDonalds, so your statistic is likely wrong. But who cares? marijuana, unlike coffee and mcdonalds, is actually medicinal. Bigmacs will kill you! 2. It's not about "competing with LA"; it's about providing access to patients. Long Beach has a very large percentage of disabled persons due to good public transportation, medical facilities, affordable housing, accessible downtown, and other factors. People with MS, cancer, etc shouldnt have to trek to LA every week to get medicine. What's your problem? Go for common sense! Pro-medical cannabis people want medicine to be provided to their patients safely! They are not a broken record, there are just a lot of people with one common interest - providing sick and suffering people with natural medicince safely and without hassle. They deserve the same amount of time as anyone else needing to speak to the council! (Especially when they are sick and have suffered through 6 hours of a meeting just to get 3 minutes of speaking time.) Mindy Kemp had a valid point to allow the product to cultivate anywhere in California - that would keep cartels out while minimizing the amount of marijuana grown in our community and instead spreading it throughout the state. We should not let the council and Mayor Foster force collectives to cultivate only in our city! This will only bring crime into our community... Equal time is a must I was very upset when Mayor Foster limited the speaking time during the last city council meeting regarding medicinal marijauna. The city council knows that this is an important issue to many people in Long Beach and they should listen to the people. Let us be fair in the law making process and not waste an opportunity to do some real good for the community. It is good to hear the opposing side of the argument, but there must be equal time allowed for all on the subject... even if it may be the "same story". Citizens for Uncommon Sen Since we have no crime happening in this City and the cops have nothing else to do.....they should spend their time watching and monitoring marijuana plants grow. How else can they justify their jobs and lawsuits against the City and ultimately the taxpayers? Fairness If you are trying to get something done, the fair way to go about it would be to give more time. Are you really going to make such a huge fair decision by giving someone 3 minutes to speak on such an important subject? The whole situation is completely wrong in the first place, hopefully everyone will end up making the best decision for the patients. Not personal Bias'. This is a health issue. If you want to provide quality medications for patients what they are proposing is ridiculous. If people would educate themselves on the subject and stop looking at it as POT instead of medicinal medicine these negative fews, bans, restrictions wouldn't be here now. If you do this the only people you are hurting is medical marijuana patients. You are not hurting all of the drug dealers, etc out there who are actually breaking laws. Please stop punishing us patients, this subject is becoming way too personal and is not focusing on us and our health. There is a CVS on every other corner and a Walgreens across the street waiting for the entire world to drop of many of prescriptions which can kill us with one dosage by side effects. Those unfortunately keep building more and more, and no one complains about that because it is of the social norm. subkerrylime Our Mayors in the past have made the mistake of trying to control the speakers at City Council I have one suggestion. If you don't want to listen to the public's opinion, no matter which side they are on, then get out of the kitch. You chose to be elected to lead this City and with that, comes the obligation of listening to the citizens. Many times over many years the Council and Mayor have had to sit and listen until the wee hours of the morning. Sorry if it disrupts your schedule, but you wanted the job. So deal with it. Barbnoble I am 77 y/o...I have been on Vicodan,Percodon and Demeral for pain for years...I still have the very first bottle of each, as after trying them for a week, they did not help! I recently went to a legal marijuana clinic, spoke to a doctor, showed him my MRI and scans, purchased marijuana and haved used it, both as an addition to wildberry tea and in a pipe(?), anyway a rubber tube with glass on each end. I carry a card that allows me to use marijuana and grow plants in my back yard...what is all of the fuss? BA Noble agree with tree hugger I agree with tree hugger. This country is so screwed up, if you think about it,it truely is a conspiracy. Drug companies only want you to use THEIR DRUGS, that's why every other commercial is a pill for this that and the other. When you have something so natural that has no side affects and can only help those that are ill. But if you use the pharmecutical drugs they try to push on you, guess what you will stay sick and that's exactly what they want. Otherwise, the doctors, the drug companies, and hospitals would go out of business! The higher ups are just scared crapless of what this GOOD medicine can do.It's all about the money, they don't care about your health or you being better. Nothing is natural anymore, mcdonalds, cigarettes, alcohol, all this crap is legal, and can eventually kill you, BUT IT'S LEGAL! And yep I put in Mcdonalds, because it's crappy fake food that will kill you slowly!!! WAKE UP PEOPLE! That's why this country is so sick!!! Don'tGetIt First of all, we've already voted on this issue. It seems reasonable to require that pot sold in CA be grown in CA. And if we made it legal, maybe we could pay for heath care
